Title of Position: Senior Vice President, General Counsel FLSA Status: Exempt Department: Office of the General Counsel Reports to: Chief Executive Officer Salary: $235,000 - $245,000 Positions reporting to this position: None About Win Win is a leading provider of shelter, supportive housing, and innovative programs for families with children experiencing homelessness, in New York City. We are seeking dedicated individuals who share our mission to end homelessness and provide families with the innovative support they need to secure permanent housing Purpose of the Opportunity The Senior Vice President, General Counsel, is responsible for providing comprehensive legal support, including legal advice, contract and policy review and negotiations, compliance, litigation management, and administration of collective bargaining agreements. Reporting to the CEO, the General Counsel will function as a strategic advisor and thought partner across the organization, ensuring the maintenance of Win's Standards of Excellence. Key Accountabilities Contract and Policy Governance Review contracts, insurance policies, leases and other legal agreements to ensure all terms are fair, enforceable and properly documented. Provide subject matter expert and strategic legal advice to the Executive Team. Anticipate issues and estimate risks strategically, identifying initiative-taking solutions to eliminate or mitigate risks. Create, manage, and maintain a litigation tracking system for continuous assessment of areas of concern and potential exposure to elevated risk and liability. Partner with Operations, Programs, and Human Capital to ensure compliance with Federal FLSA and State wage hour laws and regulations. Establish a Code of Ethical Standards for Fundraising and Development and ensure compliance. Risk Management and Litigation Manage Win's active lawsuits, including contributing to litigation strategy, reviewing outside counsel's work product, managing deadlines, and engaging in settlement negotiations and mediations. Manage other dispute-related matters and records requests, including document subpoenas and demand letters. Manage the notification of legal claims to insurance carriers and adjusters, providing all organization-related documentation to outside counsel for coverage. Oversee employment-related matters, including day-to-day advice on all employment law and labor issues. Conduct or support investigations of employee malfeasance, harassment, retaliation, and other claims; provide advice and counsel throughout investigations, including recommended solutions and outcomes. Keep the Executive Team informed of significant employment-related decisions, legislation, and governmental regulations that may affect the organization and policy (local, state, federal). Provide timely and strategic advice on ongoing employee relations, labor, ADA, FMLA, harassment, union contract obligations, employment policy, and related issues to minimize challenges and potential claims. Ensure compliance with collective bargaining agreements and lead union contract negotiations. Represent Win throughout the grievance process and in arbitration hearings, including drafting motions and post hearing briefs. Essential Functions: Must be able to ascend/descend stairs in the shelter sites visited. Must be able to sit for extended periods of time at a computer. Hybrid work environment, as needed, for organization functions and legal appearances. Qualifications: Commitment to Win's mission, vision, and values. Juris Doctorate degree (J.D.) and NY Bar Membership. At least 7 years of law firm or in-house experience; some in-house experience preferred. Demonstrated experience leading a wide variety of employee investigations. Experience negotiating and interpreting Collective Bargaining Agreements. Experience in administrative law trials, EEOC hearings and mediations and arbitrations. Experience in pre-trial advocacy skills, client and witness preparation, direct and cross examination, opening and closing arguments and briefs. Advanced understanding of employment and HR-related laws and regulations (local, state, federal). Demonstrated experience leading and influencing at all levels within the organization, keeping leaders informed of any decisions made. Excellent negotiation skills with the ability to reason and compromise. Exceptional strategic decision-making, problem-solving, and critical thinking skills. Ability to manage sensitive and confidential matters with compassion, exhibiting exceptional professionalism and tact. Excellent verbal, written communication, and presentation skills. Demonstrated ability to work efficiently, independently, and collaboratively to prioritize work and meet deadlines. Knowledge of general workplace policies and labor and employment laws, including Title VII, ADA, FMLA, ADEA, FLSA. Must possess credibility and an absolute commitment to confidentiality and professional integrity. Familiarity with and appreciation for issues prevalent in underserved communities of color. Knowledge of education, social services, and nonprofit sectors is desired.
