Introduction Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, provide legal services to the entirety of state government, and fight fraud. In the Civil Division, approximately 80 attorneys provide legal support to the executive branch agencies in the form of general counsel advice, administrative hearing prosecutions, board representation, and all stages of civil litigation. Summary Statement The Department of Justice ("DOJ"), Civil Division, Public Safety Unit, seeks a Deputy Attorney General ("DAG") to serve as general legal counsel to the Department of Correction ("DOC"), which includes the Office of the Commissioner and its bureaus. This position will primarily advise the Bureaus of Prisons and Community Corrections. Career Ladder The Deputy Attorney General (DAG) career steps and salaries are based on experience, skills, and the number of years barred. Pay Grade A14 DAG II: Salary Range $87,822/min - $92,106/max Pay Grade A16 DAG III: Salary Range $96,997/min - $99,129/max Pay Grade A18 DAG IV: Salary Range $106,626/min - $108,737/max Pay Grade A20 DAG V: Salary Range $118,238/min - $122,920/max Essential Functions This DAG will work collaboratively with a second DOC DAG to advise DOC on correctional legal issues, including compliance with constitutional, statutory, and regulatory obligations, and professional guidelines and standards. Responsibilities include: Drafting correspondence and pleadings related to sentence modification, medical care, programming, and good time calculations. Drafting, reviewing, and negotiating contracts, policies, and legislation. Offering agency training on emerging legal issues. Responding to subpoenas and FOIA requests. Advising on labor and human relations issues. Litigating significant civil and criminal matters. Serving as a liaison to outside counsel. The DAG will also assist with Delaware State Police trial boards and Merit Employee Relations Board hearings, and handle additional assignments as directed by the State Solicitor, Deputy State Solicitor, Unit Head, or Assistant Unit Head. Membership in the Delaware Bar is required. Experience with correctional and criminal law, legislative drafting, procurement, and contract/settlement compliance monitoring is preferred but not mandatory. While this is primarily a general counsel position, litigation experience is also desirable. The applicant should have excellent written and oral communication skills, the ability to identify and address operational issues in order to minimize or avoid future legal action, the ability to research accurately and effectively, the ability to work closely with DOC officials, other criminal and civil DAGs, support staff, and court personnel, and the ability and desire to learn and apply relevant laws and court rules.
